From the reporting this morning in the Manhattan case, it looks like Cohen was constantly initiating invoices and payments to himself. Then he accuses Trump of not having a written retainer agreement with him, but it’s the attorney’s responsibility to prepare that. Even so, he clearly was providing regular legal advice even at his own initiation.
What’s happening here is that Bragg and Cohen have contrived a narrative that turns the perpetrator, Cohen, into an innocent victim and Trump, who was being manipulated by Cohen (his lawyer) into the perpetrator. Cohen used his position to exploit and manipulate events.

If Cohen told Trump he was going to front the NDA money, as he claims (consider this is from the least credible source I’ve ever seen testify), is the suggestion that this proves Trump sought to avoid a federal campaign violation? How so? How preposterous! Regardless, there’s no conceivable federal campaign violation.
A fraudulent intent is required to prove a crime. But a fraudulent intent to commit what crime? If Bragg cannot articulate the crime or won’t, how can Trump have had a criminal intent to commit it, whatever it is?

Let me put it as succinctly as possible: there’s no crime, state or federal, with which to link Donald Trump or anyone else. This is a case looking for a legal basis. There is none.
Let me pose this: if every single thing Cohen says is true (it’s all false), why didn’t the SDNY bring a federal campaign violation of some kind based on his allegations? Because there is no federal offense. Because the NDA is not criminal. Because everything Cohen says, if true, doesn’t matter. Because Cohen is a serial liar on top of the rest.
Bragg is trying to prove today, and everyday, that Donald Trump committed the perfectly legal act of executing a NDA. But they cannot even prove he did that, or did that with full knowledge, let alone with the intent of committing a nonexistent federal campaign violation. And Cohen’s testimony, scripted as it is by Bragg, not only reveals what a lying sleaze ball Cohen is, but underscores that Cohen was the driving force behind it.
By the way, Cohen has lied in federal court, lied to Congress, and lied to his former client Donald Trump. He lies more than Joe Biden, and that’s saying something.
