for what energy drinks have inside, they can't expire.

that's not the point. the point is that they're selling a product that has expired 10 months ago and they know it cause it's on sale and the new cans don't have a silver lid.

if I try to sell a product ON it's expiration day , I risk €5k fine ...

right. If I keep this for a year and then drink it that's fine but selling something that is 10-months out of date is just lame.
