Harvard University responded that the Supreme Court's decision was unconstitutional but that it will certainly comply with the decision and that it considers diversity "essential to academic excellence"

Good point. I can only guess that its a state matter only and the constitution doesen't give power to make laws restricting free association within the boundaries of a state. This could be a much bigger deal than just affirmative action, if taken to an extreme, it could unravel 90% of the federal government.

Maybe I'm missing something here but the way I see it if Havard wants to run their business that way they should be allowed to. And if the quality of their graduates drops well then they can make changes or make less money.
