Yes, but you are missing the key point.

The key point is those elected officials have no authority over unalienable rights. All they can do is protect those rights or infringe on those rights. No form of democracy has power over unalienable rights. Nobody has authority over unalienable rights.

What has always made America unique is that it is based on unalienable rights.
