Correct. The code itself is, what you do with it isn't necessarily. Similar to firearms being protected by the second amendment, but shooting someone without just cause is not.
But again, we shouldn't run crying to daddy government to fix the problem for us when people are being assholes on the internet. They already have far too much power, and I would not want to hand them any more, even though I think violating someone by making a porn of them against their wishes is disgusting.
I agree keep the feds out of it, but if people can't police ourselves and not do fucked up shit then people will eventually feel no choice but to file suit and seek the opinion of the courts
It's that mentality of, "I can't do something about this myself, so I am going to get someone else to do it for me," that I find to be absolutely antithetical to a free society. Once we accept that there are some people more qualified to deal with our problems than ourselves, it is inevitable that we continue imbuing them with more and more power.
Outside of actions that cause physical harm to another person, or else destruction or theft of another individual's property, the State should not be involved in settling the matter whatsoever.
