I remember, back during the COVID lockdown, reading articles about how the Ethereum foundation had a funding round where JP Morgan gave them the bulk. Can't find them anymore. That's not suspicious, right?

I’m no securities lawyer, but the pre-sale seems enough for me to qualify it as a security because it checks all all boxes.

I think there has been a misunderstanding. He meant “is ETH a security HACK” 🤣

“The Howey test is a legal test used in the United States to determine whether a transaction qualifies as an investment contract and, thus, is considered a security under federal law.

According to the test, a transaction is a security if it is (1) an investment of money, (2) in a common enterprise, (3) with the expectation of profit, or (4) to be derived from the efforts of others”

I also saw multiple lawyer discussing it in context of ETH, it fails on every single one.
