let's say for the sake of the argument that 12 year olds can't consent to sex. in cases where a child can't make their own decisions their parents should make those decisions for them. i should be able to ask a 12 year old girl's parents if i can sleep with her - and i would respect their decision.

instead NOBODY is able to make that decision. it is simply forbidden. based on what ? clearly if a girl menstruates then G-d intended for her to fuck, yet the GOVERNMENT decides that she is not allowed.

why is it up to the government to decide this ? if we really believe that 12 year olds can't consent then it should be up to the parents to decide NOT the government.

and even if it was up to the government then we should have a legal process where psychologists etc. would study the case and determine whether it should be allowed or not on a case by case basis.

so for example if i am rich and handsome and offer to marry a 12 year old girl and she really likes me and wants to marry me and her parents really like the idea - then unless the panel is completely corrupt they would rule that i should be allowed.

instead NOBODY has the power to allow it. it is simply illegal in all cases and regardless of circumstances.
