Trump's invocation of the Alien Enemies Act is completely baseless, and it's dereliction of duty that it hasn't been struck down already. The text of the law EXPLICITLY restricts its invocation to circumstances pertaining to NATIONS and FOREIGN GOVERNMENTS, but the executive order invoking it doesn't even mention a foreign country. It targets a designated terrorist organization, which the Alien Enemies Act provides no authority for. Kilmar Abrego Garcia had a standing court order explicitly forbidding his deportation to the nation of El Salvador. Garcia was not, in fact, afforded as much due process as he was entitled to under the constitution. He was not entitled to a full jury, but he WAS entitled to be seen by an immigration judge in case he wanted to contest his charges. The Trump admin ended up in court over its intention to send two planes of deportees to CECOT in El Salvador. When it became clear they were going to lose the case, they took advantage of a break in proceedings to get the flights airborne in an attempt to circumvent the impending court order. Deploying the National Guard to Los Angeles over the ICE protests was done under a law relating to insurrections or state inability to enforce federal law. 200 US Marines were sent to support ICE in Florida. Trump tried to force states to comply with ICE by threatening to withhold transportation funding, but this was struck down in part because it's unconstitutional. Trump trying to change that by executive order is an attempt to rewrite the constitution as he sees fit.
