The Entire IPC came into being during British Rule.. . Mostly about order, but it cannot be denied that it was set to limit assemblies of more than 5 people. 5 people is not a mob, especially if the group has an aged member, a young enthusiastic chap, a servant -docile follower, or a woman. But under Section 149 IPC it can form an unlawful assembly,- the whole logic is super-flawed.

Second part reads- every person can be held responsible as they should know what the rest of the assembly is capable of. Mostly these mobs have people with little reasoning abilities, that limit their comprehensive understanding of the situation at hand. Even scientists genius mathematicians are at times unaware of the results --- then how can we pin vicarious liability to these plain folks?

In new Code such irresponsible laws, that were once used to curb freedom movement should be repealed and new laws should be added.

With advent of technology it is not tough to guess a person' personal capacity to commit a crime.
