Fatherland and state are not the same, it is in the interest of the state that you think they are the same.
The flag does not represent the fatherland, the flag represents the state, all peoples should have their own flag apart from the state flag so that they understand this division.
In the same way the judiciary should be totally independent of the state and be at the service of the people, of the homeland, since the state is not a benevolent being and its interests often go against the homeland.
Throughout history there have been independent judicial systems outside the state, but since the French revolution the state has become omnipresent.
