If I didn’t do the update; am I outside the new #apple rules? Can I still do zaps? Whats the cutoff for downloading it maybe onto a new phone? Or is it too late?

You’ll keep the zap button until you upgrade your app. New phone migration will trigger that, I believe.
If you upgrade, you can use this shortcut so you can still zap notes tapping the Share icon on notes.
