A warrant will be issued by the judge, if no seed phrase was found then there is no proof.
And there is one more thing, they don’t need any prove if the one in court declares that he owns it..

The point is, the jurisprudence following from this marvel of bitcoin the protocol will simply resolve these cases in favor of the hodler before it even comes before the court. No point in trying to prove something that can not be proven.
