Congress [in implementing the Sixteenth Amendment] went beyond merely enacting an income tax law and repealed Article IV of the Bill of Rights [the 4th Amendment], by empowering the tax collector to do the very things from which that article says we were to be secure. The 16th Amendment was NEVER legally ratified.
When notified there were only 22 States that had ratified it, the Secretary of State simply said it was ratified as he walked out the door to for the new Administration.
So far, no one wants to challenge this claiming it was reported as ratified and that is all that matters.
