Ad Valorem property taxes in Texas a not allowed per Article 8, section 1-e of the Texas constitution.

Follow me down the “delegation of powers” rabbit-hole here.

Article 8 section 1-e states:

“No State ad valorem taxes shall be levied upon any property within this State.”

So state’s argument here is that “state” (who herein has had the power of implementing Ad Valorem property taxes taken away from them) SOMEHOW hiked the power to county(state’s subordinate).

What is wrong with this picture?

We don’t even have to debate taxation of unrealized capital gains if we kill the scam here.
