from what i read (and i can't remember the source) the way the judges made up their mind was to view all available evidence presented to date and make a decision based on that. I don't have the legalese language to explain that but it seemed that due process was followed by the judges.

No, it was a joke. He has never been charged let alone convicted of anything. There was a bunch of protesters let into the capitol by the police. They were unarmed, hurt no one, had zero impact.

This. He wasn’t marching them into the building and they’re finally showing the videos and tweets where he said to go home and don’t cause violence (they were taked down that day). It will get overturned by any respectable judge.
