How are ideological punishments allowed in our justice system? A guy who murders a random person is somehow entitled to less of a punishment than someone who murders a gay guy?

It should be explicitly unconstitutional to punish the motivations of the criminal instead of the crime itself. This is why people like Trump get persecuted and all the left's favorite criminals get off - because they can't abide their ideological motivations
