But if there is only 40000, couldn't a government with infinite money create another 60000 to create a >51% attack and validate bad transactions? I know, they need to mine a block too, but they have infinite money glitch.

The amount of nodes someone has does not matter IMO. What matter is the influence of the node on the network, not all nodes have the same value. If all the big exchangers and miners come together and decide to create a soft fork. For example, the nodes of foundry and Antpool together could in certain circumstances create a fork being only two nodes.
