Yeah but the incarceration rate seems driven by the will of democracy / the people. If 51% of people want a 30% incarceration rate, that's still democracy

About 99% of humans deserve prison sentences in my opinion which could probably never happen in a democracy

That's the very issue with democracy. It is the consenting majority forcing their will on the nonconsenting minority by using the State's monopoly on violence.
