Yes they were hit but that didn’t cause the accident with the train. They had an opportunity to drive away. but they put it in reverse, and then abandoned their car. They should take the blame.
I mean I kinda agree with you but the way these things go, especially since the person was rear ended, they will argue that none of this would’ve happened if the person didn’t rear end the car 🤷♂️
