There was a famous High Court case in Australia (Mabo), which crystallised this fact into common law. The Court, being a subject of the Crown, could not make a ruling on a significant matter (terra nullis) because it was deemed outside of the Courts realm. In this case, the realm of Indigenous lore and customs was found to ‘exist’ and ‘coexist’ and that property rights derived in this realm need to be respected by the System. Bitcoin coexists as property rights in the digital realm.
