Not in Switzerland. We like to pretend that data collected by a private company shouldn't be used or transferred by/to law enforcement. I think it's anyway already done and now they want to create the legal base for that. My guess is that this law will pass.
I’m sure it’s still happening. They just get their neighbor to do it.

No. I'm not a legal expert. But I now my fellow citizens and the political structure there well enough. If I'm wrong it's even better.
On one hand yes private companies should not collect data. On the other hand, having a list with the names of the passengers is normal. For example i remember a kid that took the wrong flight and got lost for a while. They should be able to track the kid to know where it is. There are many examples. A list with tourists/passengers names is a normal thing. But keeping that data to track someone's movements is not. As in many things there is a balance that we have to keep
The problem with this law is the automated system that will be introduced. Of course the airlines have passenger lists. But there should not be an automated process to give the data to the government. If there is a case (lost kid, suspicious person etc.) then this case should be investigated individually.
Yes we cannot trust governments that's true. But without the automated system, criminals can walk away undetected.
I think the best solution should be that the government gives a list, then this list should be examined by third parties if it is legit, for example not containing refugees that have a right to asylum, then compair the lists, not by governments, to see if there is something suspicious.
