Still is. The Executive Order in question just directs the DOJ to enforce other laws if they are being broken in conjunction with desecrating the flag - which is already the DOJ's job whether there is a flag involved or not.

In other words, this E.O. is just Trump intentionally being provocative (or pandering - depending on your perspective) without actually saying anything of substance. (shocker, I know.)
