It's an interesting question. There was talk about splitting it 50 / 50. Also proves that miners are not escrow servcies.

So if we had drivechains and miners are kinda the escrow isn't this a sign that someone like a state actor could push a pool to rug drivechain users?

Yes rug, or confiscate. 26% of hash power can block all withdrawals, just by voting, essentially shutting any chain down.
