Yes addresses can be flagged and traced but it doesn’t stop a “bad guy” from simply dusting a bunch of addresses with their “tainted” bitcoin.

If you know a senator’s address you could just dust it with micro transactions. Or send to charities, fundraisers etc… essentially implicating everyone.
