1) He would probably be dead now instead of on the right side of a court victory over the government.

2) He would have re-enforced the things the government accused him of and made it easier to dismiss him and his publication as a crack-pot, right wing, extremist organization.

It that a better outcome that what happened?

Nope. He comes out looking like a martyr, now, rather actually being one, and humiliated the government for their gross overreach.
