Where do you draw the line on that?

Like, what if a kid got away from their parent while walking down a sidewalk and ran out into the street, but not into oncoming traffic. However, there was an intoxicated, whom under the influence wasn't aware of his own staye. The driver got confused and swerved the wrong way, Ultimately killing the child. Yet, although he wasn't fit to drive, he was let go by a police officer who had pulled him over 5 minutes prior. The officer didn't see the problem and just wanted to get home to his children. And the bar the driver was at before then, well the bartender didn't limit his drinking nor ask if he had a way home.

Who's fault is it that the child died?

It's like the gun issue - do you blame the tool? Lack of restrictions? Mishandling of the tool? Improper storage and negligence if a child get ahold of it?
