#[0] how is hate speech defined in the TOS? Is it equally applied to all or are there subjective/favored categories of people who are allowed to speak freely and other that are not?

Damus has no ability to censor you as it does not control the relays and has no tracking. I have no idea who is using my app. The TOS is an apple requirement.
Please make sure you are not opening yourself up to liability for not enforcing the TOS (even though you literally can't enforce it). Apple has deep pockets and an army of lawyers. (Android user; I have not read your TOS)
If Kanye makes comment about Jews on Nostr -- either of the two of the following will happen.
-- the clients will be forced to censor that content
-- the clients will be delisted from app store
-- further litigation from ADL and other institutions onto the developer
Saying that the technology doesn't allow for censorship is not a valid reason. By accepting the apple TOS, you are agreeing there are such provisions in the app if necessary.
I feel like apple only goes after those that “copy” them, after they copied someone else if that makes any sense. They’re going to pretend to see nothing because they know no one would use the App Store.
Apple reserves the right to block hate speech from their platform if they deem necessary. Failure to comply(regardless of itty bitty technical details) means the app will be delisted from the app store.
It works now because damus or other nostr clients are too small to be bothered about. Only web based apps/clients are bullet proof.
