My technical limits in bitcoin are at the edge of running a node and sending and receiving bitcoin on chain. Past that I’m still learning.

With that as background, I thought I’d share this post because it’s roughly what my understanding is.

For a new pleb dad like me no one has clearly explained why a 1000x bigger op_return makes bitcoin better, more robust, more anti-fragile, for my kids (and their kids). But there does seem to be a real risk of having CSAM on the blockchain, and thus my node, and in the U.S. that can get me sent to prison.

This is a genuine question. I’m curious to hear what others have to say.

There is already illicit material on chain.

Current US legal precident says that doesn’t reach the bar.

Ok... The mempool is definitely a cache but the full blockchain could still be up for interpretation?

I can see it both ways... So I guess it's a matter of defending your position in the Supreme Court I guess

i don’t know what the legal definition of “cached file” is, but i think the chain would common sense be cached. we don’t have control over those files, you dont do anything with those files, and you still have to go beyond to do extra work to find that data, and know how to pull it out.

oddly, of all the potential fights to have with bitcoin, this is probably one of the more straight forward ones.

if someone randomly sent your a text of binary 0s and 1s that is the data for an elicit image, the court makes their case by arguing you know what that is and you know what to do with it.

either way, i don’t think the fight as even begun. when fiat is on the ropes, how could we expect anything but for them to pull out all the stops

Cached basically means temporary... kinda the opposite of the blockchain which is permanent (exception for re-orgs)

i guess if it’s pruned it’s temp 🤣

These are both super helpful.

I’ve listened to X/Twitter spaces where Joe is holding court and while he’s obviously smart - much smarter than me - this is by far the most useful thing he’s shared. Thanks for sending this!

if you knew what block, and had used your knowledge to pull it out, then that’s possession

and if the legal system was changed to be used as an attack vector, then we have to fight the law.
