In theory in the US, if it can be proven that the manufacturers committed fraud about the safety, then they could be help liable for injuries, deaths, etc. But laws can be changed to protect pharma even further.

I think it would require a gov that could hold them accountable, and I just have my doubts about these things changing... but I still keep some hope.
