Sounds like he didn’t realize even a pure leeching for profit clone is permissible under gpl3. I can’t verify that license was used though; I’m sure you’ve noticed the license file on GitHub is empty?

I linked to the old license file in the thread above, it was all public on GitHub so you can see it there before he changed from FOSS to source available in response to competition.
