I live in MA and I remember it originally DID install automatically. I had to manually uninstall it. AFTERWARDS, after a LOT of people complained, they updated it so that it only installed if you said YES to allow it. But, no.. originally, I remember it automatically installed and would keep re-installing automatically until I "froze" the app so that it would stop working and stop reinstalling. After they updated the app, I was able to finally remove it.
