Samourai case update: The government doesn't think the prosecutors' conversations with FinCEN are a big deal.

The Government pointed to communications relevant to Count One: conspiracy to commit money laundering. According to the Government, the conversations with FinCEN could only be relevant to Count Two: conspiracy to operate an unlicensed money transmitting business.

As I predicted, the Gov't argued that FinCEN's opinions are irrelevant. Noting the end of the Chevron doctrine, the Gov't argued that "FinCEN published guidance, let alone the informal opinion of FinCEN employees, are not regulations or rules and have no authoritative effect."
