Communist Marxist "scholars" have always said that about our Constitution, because they want to sieze totalitarian control of the USA.
The truth that they refuse to accept is that the Constitution doesn't grant unalieanable rights. The Constitution explicitly tells the government that it has no authority to infringe on those rights.
At least they’re being challenged in a beautiful font.
