Three upcoming Supreme Court decisions which involve “Chevron deference” have the potential to radically change the FDA’s role in the regulation of all medications. “One of the big benefits of Chevron deference is it allows scientific and technical expertise (from regulatory agencies),” said Zach Howe, assistant district attorney for the Southern District of California. “Getting rid of Chevron [which the Supreme Court is predicted to do] would force courts into the role of making those decisions” for all medications.
