The ideas of rights is that regardless of any external action, they are yours.
If they can take them away from you anytime that they feel like, it's not a right.
Rights are not a physical part of human beings. Open a person, dissect him and you will not find any rights.
A rational person understand that rights are not given by god. A rational person understands that there is no god and therefore no one to give these rights.
Rights are a human made concept. A way to subvert politics to morality. When it is said that someone has a right, what is actually acknowledged is that in this certain field, the only way for a person to live morally is to have freedom to act according to his understanding. Therefore society must give the individual his freedom, otherwise no one in that society would be able to live a moral life.
This presupposes that it is moral for a person to act according to his rationality (understanding of the universe). It also presupposes that it is moral to act according to one's self interest (selfishness).
What is obviouse that even if society doesn't respects one's right, it still remains a right. Forcing someone to act immorally doesn't mean that morality doesn't exist. It just means that the people in power are immoral and the society will decay.
