On the 1798 Alien Enemies Act, the Supreme Court created a hurdle to rectify abuses that illegally disappeared people will have trouble clearing in time, but did not rule that the law applies to migrants. Thank you @jaredhardd.bsky.social & @fishlawyer.bsky.social for pointing out that distinction.
