The app developer can be liable if someone uses it to transmit illicit content? I’ve never heard of the developer of a web browser or SFTP client being sued for that.

It's easy with domain names. They are GM registered with the government and take liability away from the distribution venue. Nostr PubKey a are not registered yet.

And it's not about the developer, but the shipper. Which in our case, it's the same.
