Possessing a firearm intended to be fired from the shoulder with a rifled barrel less than 16 inches in length or possessing a non-rifled shoulder fired firearms with a smooth barrel of less than 18.5 inches. The $5 tax is for Any Other Weapon, which has a considerably more convoluted definition, but one way to create an AOW is to put a plastic handle on the front of your pistol.

And it’s a tax on a constitutionally protected right. It will be found unlawful as soon as they finish getting the legal foundations fully fleshed out in the courts. But the major concepts of keep, bear, arms, “right of the people,” and infringed have formal legal definitions now from the Supreme Court. Only took 200 years, but now we have the full definition of the operative clause of the second amendment and in theory the unqualified command of the second amendment now has teeth.

1934 NFA permitted banning SBR/SBS precisely because these were NOT weapons of war. But today they are weapons of war. Either way, they are firearms commonly possessed by Americans for lawful purposes, and therefore cannot be banned or taxed.
Every word of the second amendment now has an official legal definition from the Supreme Court, as of summer before last. All infringements of the second amendment must be in keeping with this nation’s historical tradition and history of restricting arms (for example, places where armed guards are provided, such as courthouses and polling places.)
it’s just a matter of time before the NFA is ruled on constitutional. It will take about 5 to 10 years and we need these Supreme Court members to stay alive long enough to get things to the Supreme Court.
