of course they can. that's how every silicon valley companies achieves greatness. make a billion by doing something illegal, they pay a few millions from lawsuits. not only do they profit from illegal activities, but they profit from the prestige and knowledge they acquire by doing it. open ai could say "we won't do thatanyonmore" Becuase they don't need to. in fact, the classic play is to go to legislators and say "what I did was illegal, pleas make sure no one can do it starting now
