Draft bill 'best opportunity' in decades for national data privacy, security standard

Sen. Maria Cantwell and Rep. Cathy McMorris Rodgers, both of Washington state, have unveiled plans for a national data privacy law called the American Privacy Rights Act. The bipartisan draft legislation aims to establish a national data privacy and security standard that gives people the right to control their personal information. The bill would rein in Big Tech and empower everyday Americans by informing them about the data being collected, how it's being used and shared, and giving them opt-out or opt-in options. It would also include limits on the use of consumer data, compliance processes, and recourse for dispute resolutions. The American Privacy Rights Act would eliminate the existing patchwork of state laws and set clear national data privacy rights and protections for Americans. It would give Americans the right to control where their information goes and who can sell it, make privacy a consumer right, and allow consumers to enforce that right. The bill would restrict data collection to relevant products and services, require companies to allow people to access, correct, delete, and export their data, and allow people to opt out of targeted advertising. It would also allow people to sue violators of their privacy rights and opt out of algorithms that make decisions about various aspects of their lives. Rep. Frank Pallone believes the bill can make it across the finish line and hopes to strengthen it, particularly in terms of children's privacy. The draft legislation is seen as a good start and has a good chance of passing.
