A new bill has been proposed in the US Senate that would permit artificial intelligence (AI) data center firms to bypass federal electricity regulations by building their own energy infrastructure.
The DATA Act of 2026 was proposed by Senator Tom Cotton (Republican, Arkansas) and would amend the Federal Power Act.
“American dominance in AI and other crucial emerging industries should not come at the expense of Arkansans paying higher energy costs,” Cotton said in a statement. “My bill will ensure that America can continue to lead in these spaces by eliminating outdated regulations.”
If passed the bill would create a new utility category called “consumer-regulated electric utilities” (CREUs), with companies who build their own independent power infrastructure falling under this new designation. In order to qualify for CREU, the utilities would have to be completed disconnected from the main grid and built solely to serve new electric loads. Consequently, if the utility subsequently connects to the grid it would lose its exempt status.

I’ve had my phone number for many many years and I’ve developed a sense, of course, for how often I get spam calls. I moved to San Diego a month and a half ago and the number of spam calls has gone up quite a bit since then.
How would spammers know that I’m here?
I haven’t posted my phone number anywhere. I didn’t fill out any paperwork with my phone number. My actual phone number hasn’t changed. Yet the spam spiked right after I got here.

Chinese artificial intelligence phenomenon DeepSeek revealed some financial numbers on Saturday, saying its “theoretical” profit margin could be more than five times costs, peeling back a layer of the secrecy that shrouds business models in the AI industry.
The 20-month-old startup that rattled Silicon Valley with its innovative and inexpensive approach to building AI models, said on X its V3 and R1 models’ cost of inferencing to sales during a 24-hour-period on the last day of February put profit margins at 545%.
Inferencing refers to the computing power, electricity, data storage and other resources needed to make AI models work in real time.
