Art major turned law professor. Teaching at Chicago-Kent College of Law. Researching & writing about #DesignPatents. Currently thinking a lot about the #ScheduleA phenomenon. Trying to make #PatentFedi happen. Coauthor of Patent Law: An Open-Access Casebook https://patentlawcasebook.com/ When I'm not thinking about law, I'm usually studying languages (#español, #français & #svenska), reading novels, or watching Netflix. Subversive Tools v. Bootstrap Farmer - New cases alleges infringement of unregistered product-design trade dress for the shape of "plant cultivation trays": https://storage.courtlistener.com/recap/gov.uscourts.nysd.603826/gov.uscourts.nysd.603826.1.0.pdf

Checking in on that #USPTO request for comments on "Future Strategies in Anticounterfeiting and Antipiracy." https://www.federalregister.gov/documents/2023/05/25/2023-10770/future-strategies-in-anticounterfeiting-and-antipiracy

Comments are due in two weeks.

Looks like there are currently a total of eight comments.

Four have been posted: https://www.regulations.gov/document/PTO-C-2023-0006-0001/comment

As some of you know, I'm currently writing about the rhetoric of "counterfeiting" in discussions of design patent law & policy. We'll see if any of these comments end up being included in my next draft.

My biggest advice is: Follow a lot of people. Like a lot. Like way more than you think in necessary/appropriate. You can always unfollow later.

And if you're into lists, the Advanced Web Interface is pretty great.

Looks like the OG has been posted. Still no bulk patents. 🙁

That oh-so-satisfying feeling when you're revising a draft and you realize, "oh THIS is where that piece goes!"

It occurs to be that there are many interesting parallels between:

"I don't see other men being jerks on this platform, therefore it must not be happening"

and

"I saw her speak at a conference last month, therefore the investigation must be a sham"
