May 19, 2021, Texas Heartbeat Bill signed into law. At the time it was signed into law, it clearly contradicted both Roe and Casey.

September 1, 2021, the law went into effect *after* the Supreme Court denied an emergency petition from abortion providers in TX.

For 9 months SB8 was in effect when Roe was still good law and there was a constitutional right to access an abortion.

June 24, 2022, Court handed down Dobbs which overturned Roe v. Wade.

How they reach the end result—through jurisdictional limits or withholding funding if an ethics code is not adopted appears to be within their power.

Do you think that makes a difference? The GOP is attacking institutions of governance, especially the criminal justice system. Democracts are also attacking the courts but doing it more through institutional channels—ethics codes, changing the number of Justices, changing jurisdiction—all allowed.

Recently, Justice Alito said “I know this is a controversial view, but I’m willing to say it. No provision in the Constitution gives them the authority to regulate the Supreme Court — period.”

I wonder if he would accept the same being said about the #SCOTUS’ authority to determine the meaning of the constitution. There is nothing in the constitution that gives SCOTUS the final word on its meaning. Yet, it dictates to the other two branches all the time. The hubris!

There is no doubt that Mark Meadows or Georgia will appeal the removal decision and it will likely reach #SCOTUS on the shadow docket. Guess who will review it first--Justice Thomas. As we know--he won't recuse himself nor is he required to do so. He could stall the proceedings pending full Court review.

In its report PenAmerica describes “forced outing” bills—laws that require schools to inform parents if a student is presenting differently than the sex assigned at birth. Let’s dive into Alabama’s law. It makes if a Class C felony for school personnel to “withhold information” from a parent about a “minor’s perception that his or her gender or sex is inconsistent with the minor’s sex.”

Anyone know what this means? It’s a crime not to.

Three years later and my blood sill boils when I listen to Trump’s calls to Georgia. And three years later he still sounds desperate and pathetic. And three years later I still cannot believe how many people, especially lawyers(!), who enabled and assisted his delusional efforts to undermine our election.
