And no doctor in their right mind is going to cut the head off of a live baby with a bunch of witnesses, i.e. nurses, watching, including watching heart rate monitors, etc. Short of absolute medical necessity to save the life of the mother, I'd presume that's murder one even in the most liberal states. The baby had to be dead. If it wasn't, this doctor has more to worry about than mere malpractice.
