Congress can definitely regulate the size, which is why I offer packing as the simplest solution. We have done it, and there is ample legal precedent.

Sure. It'd take more wrangling over the terms, and very likely a constitutional amendment, because the inclusion on the court is governed by nomination by the president with confirmation by the Senate.
