Imo it depends on the intent (mens rea) of the author; jailtime depends on what damage can be proven in a court of law.

If it is made with intent to cause reputational damage in the eye of the public, then there is (or should be) chances of significant recuperation. I'm unsure about how many gases in the US have resulted in jailtime for defamation, as this is usually settled in Civil suits.
