And spread it in some Dutch Nostr community groups.

It would really make a difference when people don’t have to agree with signing away their IP right to use a social media platform tho.!

Hi Darren, all nostr apps have a ToS, primarily to protect us against legal issues, copyright, csam etc. we also use a variety of APIs like stability.ai, and they require us to add their api tos to our tos, etc. If someone tries to sue us because we used or someone else used their picture, they can’t. If we get in trouble because someone is uploading csam, this should protect us. Otherwise we don’t care and don’t use people’s IP.

I do understand all Nostr clients need to protect their legal entities from copyright infringement claims and csam etc.

At the same time the TOS can be used against the users of the Nostr clients that use Nostr build at some point which would be a catastrophic event for all users of the protocol.

A few suggestions to look at:

- A standard or a optional choice to have your images, videos and or audio files automatically deleted after a certain period of time.

- Utilising Bitcoin DeFi open source protocols like Ordinals or BitVM (still in development) for non fungible tokens that can inherently hold I.P. rights. Inscriptions are a great example for a image standard that could be implemented with several clients which could help a lot in regards to tracking, trading or licensing these rights.

Think outside the box!

It will help Nostr.build on the longterm with minimising its responsibilities in regards with I.P. rights and driving adoption for ownership of content.

So a few additional points for you to understand:

You talk about a ToS holistically like we should remove it altogether or think outside of the box. There is no way around a standard ToS. It is not worth the legal ramifications of not having one or experimenting. Every media uploader, social media client or platform, everything has a similar ToS. Our code is open source and ‘I dare you’ to host a free internet media uploader without a ToS. (Don’t mean to sound like an ahole here but you get the point). If we had $millions coming in maybe we could experiment, but we are small and don’t want to lose our house providing this service.

Our Free View Media gallery simply combines all of the free uploads into an easy to see gallery of all media ever uploaded and is no different than someone scanning through nostr images manually. If someone manually scans or uses the gallery to snag someone’s meme or vacation photo to re-use, we still need to be protected. Everything online is shared and copied, we just need a way to protect ourself against this.

We often recommend people to host their own content, especially if it is sensitive, personal or for whatever reason. The beauty of nostr is you have that option. Don’t like the ToS, host your own media or find a media uploader that doesn’t have a ToS.

Lastly, it is a ‘free’ service for users in that they pay nothing for us to host millions of media files. There is a huge cost for us and by using this service, the ToS is what users have to pay for our protection. If you are not paying for the product (hosting your own media, purchasing accounts through us or anyone else) you are the product..
