does having that legal fiction do more harm or good? or maybe would there be another way to get some of the good with less of the bad?

I think it does zero good. Any criminal or civil action is against the company, not the actual people who made the decsion. It also requires, by law, to maximize profits for shareholders if a public corp, pretty much by any 'legal' means necessary. I mean, if you or someone can think of a benefit of a 'legal' protection racket, Im all ears, but I really can think of none. And I say this as one is very much in favor of capitalism, just not the state run versions that exist today. Plus, look at the covid days. That is exactly what the state thinks of small business, unessential.
