If you're driving while intoxicated but technically your car is fully self driving without your input, are you actually driving while intoxicated?

If I get a ride home from the bar intoxicated in a robo taxi, how is this different?

Are you able to take control of the taxi? That's probably the difference. The consumer vehicles still give people control of the car. If the taxis do too, then I'm at a loss.
