You don't understand how this works. They can just get that information correctly and refile, and you're assuming the bad search was their only basis in the first place, which isn't true.

You want him to get out, so you think he will. That's not how it works. Bad searches happen literally all the time and only in rare cased result in charges being permanently dropped.
